EACC on its twitter handle said the Commission had filed a suit challenging the illegal allocation of public land reference Kakamega Municipality/ Block III/245 to a private developer who has been identified as James Musau Kiva.

The land, upon which a government house is erected, was public property held in trust by the defunct Kakamega Municipal Council and was reserved for housing civil servants.

Subsequently, the court issued orders directing the land registrar in Kakamega to cancel the title deed issued to Kiva.

The court further issued a permanent injunction restraining Kiva and his agents from trespassing or dealing in any way with the property.

It declared that the lease issued to Kiva on 31st August 1999 is null and void, thus the land will revert to public use.
