
A Nakuru court has pronounced Kapseret Member of Parliament (MP) not guilty after an accusation of allegedly insulting President Uhuru Kenyatta’s mother, Mama Ngina Kenyatta.
According to Principal Magistrate Isaac Orenge, the case was thrown out after the state failed to produce enough evidence to support the suit.
Further, he said that there was no corroboration to indicate that Sudi’s remarks prompted unrest or subsequent disruption of peace.
“I have considered the evidence tabled. There was no witness who stated what effect the words uttered had on them,” said Orenge.
“There is no evidence that was presented to warrant the accused to be placed on his defence,” added the magistrate.
Orenge went further and faulted the social media accounts used to share the viral video, noting that some fake accounts were created at the time of Sudi’s arrest in September 2020.
“Some of the accounts that were used to comment on the said clip were not verified. Some accounts were created shortly after the clip aired,” he said.
Sudi was arrested after a video went viral on social media that captured him giving inflaming utterances on September 7. He was charged with three counts of incitement and hate speech and was released on Ksh500,000 cash bail pending the hearing of the case, which has now been terminated.
