The High Court at Milimani Anti-Corruption Division on Thursday dismissed an application filed by former Treasury Cabinet Secretary Henry Rotich challenging the charges instituted against him in the Arror and Kimwarer Dams scandal.
Rotich, alongside four others, is facing charges ranging from conspiracy to defraud the government, willful failure to comply with procurement rules, abuse of office, engaging in projects without prior planning, failure to comply with laws on managing public funds, and financial misconduct.
The ruling affirmed DPP’s position that “the charges were properly instituted by the Office which has powers to institute criminal charges under Article 157 of the Constitution.”
In the case, the former CS and the co-accused have been charged with conspiracy to defraud the government more than Kshs.63 Billion by entering into a contract for the construction of the two dams without the necessary approval.
The case on Arror and Kimwarer dams’ scandal will be heard on 28th March 2022.
