Senior Counsel Prof. Tom Ojienda thrown under the bus by former partner

The lawyer at the centre of the ongoing probe into the fraud involving the loss of more than Sh200 million at Mumias Sugar Company is now officially a state witness.

Peter Wanyama, better known as Peter Manyonge Ongrapas or PMO,
was officially unveiled as a prosecution witness by the Directorate of Public Prosecutions in a statement released earlier Thursday morning.

In his tweet, the DPP said he had analyzed Wanyama’s statements and lined him up to testify in the case against Prof Tom Ojienda.

The DPP further clarified that Wanyama was neither arrested alongside Prof Ojienda nor recommended for prosecution by the same office.

The Ojienda arrest unfolded during a week of high drama in which DPP Noordin Haji said his office and that of the DCI had received several reports of financial misappropriation and fraudulent dealings which affected sugar millers, including Mumias.

A team of investigators was therefore constituted by the DCI to inquire into allegations that fake court proceedings, numbers and parties were used by several legal service providers to obtain money (fees) from Mumias.

Ojienda has however strongly denied any involvement.

I have read the Director of Public Prosecution's statement with utter shock and disbelief. I would like to state without any fear of contradiction that I do not, I cannot and I have never filed a fake case. I have never conspired with any person to be paid for work not done.

Back to lawyer Wanyama’s, sources close to the Nairobi lawyer, who has now gone into hiding, told Kenyan News Day that Wanyama made a deal with the ODPP to save his own skin after he was exposed in numerous corrupt deals involving several county governments.

It has also emerged that Wanyama worked as a ‘double agent’ with one of his colleagues in the legal profession, Nelson Havi, outrightly accusing him of acting as a spy to fix Professor Tom Ojienda.

Peter Wanyama is a shameless traitor and wet boy. He has been hovering around Professor Tom Ojienda and his legal team, collecting intelligence and transmitting it to his masters. He is indeed a witness in the intended prosecution of his master and mentor. Judas Iscariot reborn! pic.twitter.com/GhSAiihTDn

Currently practicing as the Managing Partner at Manyonge Wanyama Associates and Advocates, Wanyama has curved a reputation in legal circles earning himself generous but fradulent emoluments  from government institutions and financial institutions.

Investigations by Kenyan News Day revealed that flamboyant Wanyama had on various occasions demonstrated a flagrant disregard of ethical standards and suffered a severe lack of integrity.

A former employee told us how Wanyama often made false declarations in tax returns and helped clients escape the tax man thereby denying the government much needed revenue.

Lawyer Nelson Havi accused Wanyama of reprehensible conduct in knowingly betraying his former partner and fixing him to save himself from atrocious breaches of the law.

DCI has a damning file on Peter Wanyama relating to theft of millions from a County Government in Western Kenya, which file has not been acted upon. It does not therefore, surprise that he has been sanitized overnight from a suspect to a witness against Professor Tom Ojienda.

Legal commentators outrightly dismissed the competency of Peter Wanyama and Professor Justice James Odek to act as witnesses in the case against Prof. Tom Ojienda. The thinking is that the trio should all be behind the dock facing trial.

Kenyan News Day reliably learnt that whereas Ojienda was paid Sh200 million by Mumias Sugar Company, he only paid his partners Wanyama and Odek Sh. 5million each sharing the balance loot of Sh190 million with former Mumias CEO Evans Kidero.

Kenyan News Day also established that Wanyama had jointly with others defrauded the county governments of TransNzoia, Kericho, and Bomet of tens of millions of shillings in a carefully conceived scheme involving fake cases and double invoicing together with associates working within those governments.

At various times, the boisterous and flashy Wanyama provided legal representation to the governor’s of the three counties Messrs Patrick Khaemba, Paul Chepkwony and Isaac Ruto in high profile petition cases.

In yet another case not in public domain, Wanyama, then working as Legal Officer, defrauded his employer K-Rep Bank of hundreds of millions of shillings and used his connections to defeat justice.

Wanyama was arrested in a dramatic raid at his home from where part of the stolen funds were recovered before he was charged in court.

It is widely believed that DPP Haji, a former high ranking Intelligence Officer, used this case to coerce Wanyama to implicate Ojienda or face criminal prosecution.
