Mr Nyakundi is accused of killing his last-born son, Joseph Bogonko, on March 17 this year in mysterious circumstances.

The Director of Public Prosecution (DPP) Noordin Haji has defended his decision to review criminal charges against City Lawyer Assa Nyakundi.

In his response to the application by Nyakundi’s wife Lydia Kung’a, the DPP said the applicant was a prosecution witness and cannot dictate review of the charges.

Lydia had opposed the DPP’s bid to withdraw the charges arguing she was never consulted and the court should revise the decision.

She further blamed the prosecution for disclosing her names and that of her son to the public listing them as state witnesses.

The DPP further said that the manslaughter case against Nyakundi was withdrawn.

He argued that the application had no legal or factual basis and should be dismissed.

The Director of Criminal Investigations George Kinoti had earlier disowned a manslaughter charge against Nyakundi.

Lawyer Assa Nyakundi is accused of killing his last born son last month.

According to Kinoti, the two senior officers alongside two prosecutors allegedly engaged in a ‘cover up’ attempt of the murder.

Elsewhere, four suspects in the murder of Chuka OCS Joseph Kinyua were Tuesday arraigned before Runyenjes court but could not take plea as police are yet to conclude investigations.

The Director of Criminal Investigation through an affidavit presented in court sought for more time to allow completion of investigations on the four suspects.

Embu Senior Principal Magistrate Josphat Gichumi in response allowed the police to hold the suspects in custody for 14 more days to conclude their investigations.

The court ordered the four suspects to be remanded at Runyenjes police station until May 20 when they will be arraigned in court for further directions.
