The CommunicationsAuthorityofKenyahasnotedwithconcernthatbroadcastingstationsareairingandpromotinggamingactivitiesandrelatedadvertisementsinblatantviolationofthe provisionsoftheKenyaInformation&CommunicationsAct1998(KICA),KenyaCommunications(Broadcasting)Regulations2009,the ProgrammingCode,Broadcasting licenseconditionsaswellastheBetting,LotteriesandGamingAct,Chapter131oftheLawsofKenya.
Broadcastersarerequiredbylicenseconditionstoensure thattheirprogrammingcontentorservicesandanypromotionalmaterialsmustnotbefacilitatedorencouragedespeciallythatwhichislikelytomisleadthroughinaccuracies,ambiguities,exaggeration,omissionsortakeunfairadvantageofanycharacteristicorcircumstancewhichmayexploitconsumers‘vulnerabilities.
Further,Sections20and34of theBroadcastingRegulationsandSection3oftheProgrammingCode,prohibitsairingofcontentintendedforadultaudiences,specificallythatwhichisunsuitableforchildrenduringthewatershedperiod. The watershed period runs from 5.00 am to 10.00 pm East African time.
TheAuthoritysoughttoremindbroadcastersthatanyairingofgamingactivities(betting,lotteries,andprizecompetitions/promotions)onbroadcastingplatformsmustfullycomply withtherelevantprovisionsof theProgrammingCode.

Therefore,therewillbenoairingofprogrammingthatpromotesgamingandgamingadvertsduringthewatershedperiodasprescribedundertheKenyaInformationandCommunicationAct1998,theKenyaCommunication(Broadcasting)Regulationsandtheprogrammingcode,witheffectfromThursday,9thSeptember2021.
Failuretocomplyfullyshallleadtoregulatoryactionsbeingtakenagainstanyviolation,whichwillinclude,butnotlimitedto,levyingpenaltiesasprescribedinSection83AoftheAct,suspensionofbroadcastinglicense,andrevocationofassignedbroadcastingfrequenciesand/orlicenseswhereapplicable.
TheAuthorityfurther soughttoassurethepublicthat they wouldcontinuetomonitortheprogrammesairedbybroadcasterstoensureconformancetotheprovisionsoftheKenyaInformationand CommunicationsAct,theBroadcastingRegulations,theProgrammingCodeandlicensingconditions andallotherattendantlaws.
Membersofthepublicwereencouragedtoreportanyincident,whereabroadcasterairsgamingactivitiesduringthewatershedperiod,totheattentionoftheAuthorityorBCLB.
