The Judicial Service Commission (JCS) is recommending removal of three high court judges from the bench.
The commission says complaints received against Justices Njagi Marete, Martin Muya and Lucy Waithaka established that three are guilty of various violations of judicial practice including bias and impropriety and must face a tribunal to dismiss them.
In the meantime, Supreme Court judges J.B Ojwang and Njoki Ndung’u have been handed a clean bill of health after allegations of misconduct against them in a case involving former MP Nick Salat fell short of the threshold to warrant any action from JSC.
Flanked by other members of the commission, Chief Justice David Maraga said the three judges had failed to meet the threshold to serve at the corridors of justice citing various violations established in their line of duty.

Maraga says the commission says it spared the two over lack of substantial evidence to warrant any action against them.
Chief Justice Maraga also noted that he had filed his response in a petition against him and four other apex court judges in regards to Wajir gubernatorial petition.
In Thursday’s sanctions by JSC, five magistrates have been served with charges on various acts ranging from irregular released of exhibits, forging of documents, bribery among other forms of corruption with the magistrates given 14 days to file responses.
