In a statement issued on Saturday, May 18, Haji warned the content of the audio recording had incited a huge response and incensed Kenyans, especially because it appeared to suggest the president, interior cabinet secretary and former prime minister were part of the gold scam.

"My attention has been drawn to an audio clip making rounds on social media in which an apparent telephone conversation between two speakers, allegations are made suggesting certain information had been conveyed to HE the President, former prime minister and CS Matiang'i, and that a discussion had been held between the eminent personalities.
The caption on the audio clip claim that the conversation was between two persons relating to an ongoing investigation into an incident of fake gold found within the city (Nairobi)," the statement read.

The DPP warned such claims and their circulation through social media, especially the leaked phone recordings, may needlessly cause disaffection.

"Until all facts are obtained and analysed it is irresponsible and possibly unlawful to publish such materials to the public," he stated.

Haji noted he had personally received a complaint and representation from victims of the scam claiming the the Kenyan personality mentioned in the audio had been dealing with them for sometimes during which he invoked the president's name in the dealings and conversations.

He said the victims of the gold scam had already made formal reports to the Kenyan authorities and and are willing to cooperate with law enforcement agencies in unearthing the under-dealings.

"As part of my constitutional mandate, I have directed the Inspector General of Police to expedite the on-going investigation into the gold scams and forward the resultant investigation files to me within seven days the report from which appropriate action will be taken," the DPP said.
