Devolution PS Summoned to Court for Assaulting Pregnant Wife

Milimani Chief Magistrate Susan Shitubi has called upon Devolution Principal Secretary, Julius Korir, to answer charges of assault against his wife, Evelyne Koech.

This is after the Office of the Director of Public Prosecutions (ODPP), through State Prosecutor Alice Mathangani, ordered a fresh prosecution after his attempt to block the case in 2021 failed as it was repudiated by High Court’s Justice Anthony Mrima.

“The petitioner has not shown how the DPP violated the Constitution by authorising his prosecution, further, if the court quashes or grants the orders sought, it will frustrate the rule of law,” Justice Mrima ruled.

In an incident reported at Hardy Police Station, Karen, in 2018, Koech had accused Korir of allegedly aiming blows at her despite her being pregnant with his child.

Medical reports indicated that Koech had suffered injuries on the abdomen, the forearm, and the legs.

This was the second time Koech had reported assault by the PS. In another different case that was filed earlier, Koech had assigned guilt to Korir for assault but was never arraigned after moving to court to block DPP from having a hand in the case, a move which was successful.

However, the court had barred the PS from living with Koech or using allies to frustrate her pending hearing and determination of the case.

He was given 15 days to appear in court regarding their divorce case, which was also filed, and another separate case in the Children’s Court, where he faced another accusation of neglecting his responsibilities towards their kids.

Following a series of cases in court, the PS risks losing his top job as stipulated by Chapter 6 of the Constitution and Leadership and Integrity Act.

“Any State officer automatically goes on suspension after taking a plea in a criminal case.”
