Ousted Kisumu county assembly speaker Onyango Oloo(Pictured above) should has lost trust of both members of the public and assembly members.
A lawyer for the assembly in a civil suit where Oloo is challenging his ouster Elisha Ongaya told Justice Nduma Nderi that it would be in bad taste to return Oloo to the assembly as speaker.
Oloo has moved to the Labour and Employment Relations court in order to challenge his removal. He contends that his ouster was unprocedural and against the law of natural justice. Oloo says that he was not served properly before being impeached by members of the county assembly.
Through his lawyer Muga Apondi he argues that he was removed from his position out of a criminal case which is not in any way related to the assembly.
Apondi said Oloo was chased away from the assembly when he attempted to go there. Oloo is the petitioner in the suit while the county public service board, the assembly and the officer commanding police station, Kisumu are listed as the respondents. The acting clerk Owen Ojuok is an interested party in the suit.
Carlos Odhiambo also appearing for Oloo referred to the cases of Nairobi speaker Beatrice Elachi, former Kisumu speaker Ann Adul, Homa Bay speaker Elizabeth and Embu governor Stephen Wambora as cases where the petitioners were not properly served during their impeachment and were subsequently reinstated.
Judgment will be delivered on December 10
