Nairobi county askaris to pay Ksh427K to hawker whose teeth they plucked over Ksh100 bribe

Three Nairobi County askaris agreed to pay Anthony Maina for damages and compensation after they plucked out his teeth and caused grievous him harm.

The three settled for an out of court agreement in order to save their jobs and avoid prosecution over the matter.

Through an agreement signed before Anthony’s lawyer,
Harrison Musyoka the three asked for forgiveness choosing an out of court
settlement of the case.

“Humprey Muswangi, Hassan Chege and Dennis Macharia are
the respondents in this matter of assault having accepted their personal
liability jointly and severally over their assault on Anthoney Maina and have
offered to settle this matter out of court” the agreement read in part. 

This is after Lawyer Harrison Musyoka wrote a demand letter
to Nairobi County to accept Liability for assaulting the Hawker within 7days
after K24 Digital highlighted the hawker’s story.

Through his Lawyer, the hawker demanded an immediate written
admission of sole and vicarious liability from Nairobi City County for the
grievous harm and loss caused to him by the county officers upon which the
lawyer shall proceed to address the City County on the special and general
damages for compensation. 

“Unequivocally, jointly and severally admit and accept
their personal liability over the assault on Anthony Maina on July 2, 2021 that
caused him grievous harm and loss,”read part of the agreement 

The three askaris have offered jointly to compensate the
claimant Ksh 300 for loss of 5 teeth @60,000 each, Broken Jaw Connection Ksh
56,000,Fare/transportation Ksh4000,[email protected],Rent @Ksh15000 and clinic
visits @14000 all totaling at Ksh 427,200.

The said amount shall be paid to the mobile number of the
victim Anthoney Maina on August 3,2021
