45-year-old Meru man sentenced to life imprisonment for raping and infecting his 15-year-old daughter with HIV/AIDS

A 45-year-old man by the name Francis Muriira from Muthara
ward in Tigania East has been sentenced to life imprisonment after being found
guilty of raping his 15-year-old daughter and infecting her with HIV.

In his ruling, Kirindine Court Magistrate Paul Wachuli said
it’s unfortunate for a father to do such a beastly act to a child whom he is entrusted
to protect.

The clinician who was helping in the investigation said that
the man was fully aware of his status.

The clinician went ahead to reveal that the man knew he was on
ARVs yet he went ahead to commit the heinous act.

“The clinician and the IO proved beyond reasonable doubt that at the time of committing this offence you were HIV positive.

“The clinician told us that you are a known patient. You are
on ARVS for sometimes so you knew you had that disease but you still went ahead
to have unprotected sex with your daughter.

“For the minor the clinician again, witness number 3, proved that she, unfortunately, contracted HIV as well. Her tests turned positive on examination,” Wachuli read.

“So, I’ll sentence you as follows; count 1 since the victim
is below 18 years old, I’ll sentence you to life imprisonment in terms of
section 20 of the act. Count 2, I’ll also sentence you to life imprisonment. These
sentences will run concurrently,” he ruled.

The suspect was handed 14 days to appeal.
