High Court has dismissed an application by Silas Jakakimba, one of Raila Odinga’s long-serving aides, seeking to bar his baby mama from stopping the transfer of his 8-year-old son from St. Nicholas School.
Jakakimba had transferred the minor from Riara School to St.
Nicholas School and was seeking orders restraining the lady from removing the
minor from the school or taking any other action or omission aimed at interfering
with the minor’s schooling at the said school.
The judge in his ruling said that the justification by Jakakimba to transfer his son from Riara school is unreasonable.
“The date for opening school cannot be used as a reason
to circumvent court orders,” ruled justice Mugure Thande.
Silas Jakakimba who is the plaintiff in the application
contend that the court issued a decree dated April 27,2021 to provide school
fees and school related expenses for the minor and that parties were to
mutually agree on the choice of the school for the minor.
In court documents, Jakakimba claimed that he wrote to his
alleged baby mama proposing that the minor be transferred either to Strathmore
School, Kiota School or St. Nicholas School.
He further said he sought permission for the minor to be
cleared from Riara school in order to attend interviews and take up admission
at St. Nicholas School which the baby mama did not object.
Jakakimba avers that out of nowhere the lady has instead
proceeded to threaten the management of St. Nicholas School against admitting
the minor.
Jakakimba removed the minor from Riara school claiming that
the school had treated him with contempt as they had not acknowledged him as
the biological father of the kid.
The lady in her response claims Jakakimba transferred the
child from Riara by threatening them, saying that the school cleared the minor under
duress from Jakakimba who had caused commotion and havoc.
“The plaintiff only moved to this court after he had already taken matters into his own hands through issuance of threats. That by the time he had moved to court, he had already enrolled the minor at St. Nicholas School. He transferred the minor well aware that I had paid the entire term’s school fees,” claims the lady in her affidavit.
She further says since Jakakimba transferred the minor from Riara
School he has denied her access to the child.
