LSK boss Nelson Havi will not be prosecuted until a case challenging his criminal charges is determined.
High Court Judge Julius Ngaah issued the orders in an urgent application filed by former Magistrate Bryan Khaemba.
The DPP wants Mr Havi charged for Assaulting LSK CEO Mercy Wambua.
He was held at DCI headquarters and later released on a Sh10,0000 police bond.
