Court Frees Meru Senator Mithika Linturi

Meru Senator Mithika Linturi has been set free by a Nakuru Court after the prosecution failed to confirm incitement charges from the sentiments made during a United Democratic Alliance (UDA) rally in Eldoret last month.

In his remarks, Linturi had asked Uasin Gishu residents to oust ‘madoadoa’ who do not support Deputy President William Ruto’s presidential bid.

While making her ruling on Monday, 28th February Nakuru Chief Magistrate Edna Nyaloti said that the case had been closed after the police failed to meet the deadlines given by the court to present evidence.

She also directed that the cash bail amount paid by the Senator should be reimbursed.

“The application by the prosecution to have the miscellaneous application closed and withdrawn is hereby allowed and the court directs that the cash bail be released to the depositor,” judge Nyaloti ruled.

Nyaloti further directed the Senator not to contact witnesses either through proxy or directly.

Speaking after the ruling Linturi said: “I am very concerned about the wanton misuse of public resources by the office of the DCI in arraigning people in court and wasting judicial time on matters that are not necessary. The resources should have been used to serve Kenyans better,” he said

Senator was arrested at Rupa Hotel in Eldoret on 9th January and taken to Kaptembwo Police Station, where he was taken to custody over his ‘madoadoa’ remarks.

He was later released on a Ksh5 million bond or Ksh2 million cash bail over the alleged incitement remarks.
