The Environment and Lands Court has issued a warrant of arrest against Machakos Governor Alfred Mutua for defying orders to pay a Ksh5.5 million in a dumpsite case.
In court documents seen by Litkenya.com, Governor Mutua was on 30th July, 2020 ordered to pay businessman David Gitau Thairu Ksh.5,590,443.15 after trespassing and dumping waste into his land.
The court ordered that Thairu be compensated for the damages caused, an order that Mutua failed to honour.
The warrant to arrest Mutua was issued by Machakos Principle Magistrate C.N Ondieki.
Ondieki ordered Machakos Police Station OCS to present Mutua in court as soon as possible unless he pays the said amount.
“You are further commanded to return this warrant as soon as it is executed or the money noted in the margin is tendered to you with an endorsement certifying the day on which and manner in which it has been executed, or the reason why it has not been executed,” wrote Magistrate CN Ondieki.
Apart from paying the Ksh5 million, the court had also directed the Governor and his administration to remove waste dumped into the parcel of land in Machakos town.
