Court temporarily stops Ksh.58m fraud case against Evans Kidero

Kidero argued that the fresh charges being levelled against him are defective.

The High Court has temporarily stopped the 58 million shillings fraud case against former Nairobi Governor Evans Kidero and others.

This is after Kidero moved to the high court challenging the decision by the prosecution to charge him afresh Monday morning.

High Court Judge John Onyiego suspended the proceedings after Kidero argued that the fresh charges leveled against him were defective.

In his application before the High court, Kidero said the trial court failed to determine the question of the defective charges.

Kidero, George Wainaina, John Kariuki, Paul Mutungi, Manasseh Kepha, Philomena Nzuki and ten others were  to plead afresh Monday morning to offenses said to have been committed in 2014.

He said the trial magistrate Douglas Ogoti summarily dismissed the objection on the basis that it was incompetent because of an earlier ruling delivered by the court on the same.

According to the charge sheet it is alleged that they conspired to defraud the Nairobi City County of over 58 million shillings.

However, Kidero moved to the high court challenging the decision by the prosecution arguing that the fresh charges being leveled against him are defective.

In January Kidero declined to plead afresh to charges though earlier, he had pleaded not guilty. His lawyer Julie Soweto said the prosecution was yet to serve them with the fresh charge sheet.
