A day after Deputy President William Ruto delved into the recent changes in parliament that saw his allies kicked out of key parliamentary committee positions, his allies have responded swiftly, defying his orders to unite.

The MPs have now turned the heat on ODM, threatening to take the battle to the High Court in what is turning out to be a new battle.

Ruto’s associated now want ODM as a party to cede its position as the official opposition and handover to Amani National Congress (ANC) led by Musalia Mudavadi.

Media reports indicate that Soy member of parliament Caleb Kositany and his Aldai counterpart Cornelly Serem disclosed plans to write to the speaker of the National Assembly seeking clarification on the true position of ODM in the wake of recent development.

The MPs maintained that ODM has joined the government and have even taken up majority side plum positions, hence do not deserve to be in the opposition.”

The lawmakers confirmed that they will take the battle to the High Court to have a clear interpretation on whether ODM should continue acting as the opposition at a time when its members have joined the majority in Parliament.

“We have
resolved to write to Speaker Muturi to give a ruling on whether we still have a
Minority (parties) coalition in the current political setup. ODM is basically
in government and should not continue drawing benefits of the Minority party.”

“ODM is running
the government and Kenyans cannot expect them to oversight the excesses of the
same government. The only party which is still practicing opposition is ANC. It
would only be fair if they are allowed to occupy the seats.” Kositany
said.

His views were supported by his Aldai counterpart who expressed readiness to battle ODM from the opposition.

“You cannot
be in government and at the same time be in the opposition. How can you
oversight yourself? you cannot be a referee and a player at the same time……We are first going to seek a ruling by the
Speaker. If we don’t succeed, then we will proceed to the High Court for
interpretation,” Serem said.
