Former rugby player Alex Olaba has been charged with conspiracy to murder.

Olaba who appeared before Chief Magistrate Francis Andayi denied the charges and will be remanded until Monday next week pending a ruling on bail cancellation in gang-rape case.

On Monday, Andayi who was expected to give a ruling on the bail terms deliver it because such an application to deny the accused bail was before another court.

“The same application is before another court and I find it best placed to give a ruling as it will be a duplication of rulings on the same matter,” said Andayi.

Andayi added that the prosecutors in the case had made an application before Magistrate Zainab Abdul objecting the suspect from being released on bond over security concerns of the witness.

Stating that it was better for that other court should handle the matter as the objection was first filed there.

It is alleged that on diverse dates between 14 April and 22 April within Nairobi county, jointly with others not before the court, he conspired to kill the witness. Olaba faced another charge of conspiring to defeat justice.

The prosecution led by Everline Onunga and Angela Fuchaka had on Monday opposed the suspect being released on bail.

They told the court that if Olaba was released on bail he would interfere with state witnesses more so by killing the complainant.

“Your honour the suspect before you is out to ensure that the witness does not testify in court. This he wants to achieve it by killing her,”said the prosecution side.

In another court in Milimani the prosecutors in Olaba case where he’s charged alongside another former rugby player Frank Wanyama asked the court to cancel his 300,000 shillings bail.

Olaba and Wanyama are in that case out on a cash bail of  Sh.300,000.

“Your owner we ask this court to cancel Olaba”s cash bail because he has committed an offence while out on bail.We also ask for protection of the witness and the case to be heard in camera for security reasons,”The prosecutors told Magistrate Zainab Abdul.

A ruling by magistrate Abdul on this applications will be on May 10.

The suspect  is being held at Industrial area prison.
