The court has adjourned a criminal case facing businessman Humphrey Kariuki over his health concerns.
Peter Njenga, who was the second accused, said that Kariuki was not in a position to stand trials until cleared by his doctor.
Kariuki’s lead lawyer Senior counsel Philip Murgor had also withdrawn from representing him however his other lawyers Kioko Kilukumi and Cecil Miller told trial magistrate Francis Andayi that they were ready to proceed with the case in which their client was charged in 2018 on allegations of tax evasion.
The magistrate directed that the second accused, Peter Njenga, avail the medical report on 9th of June 2021 for the court to make consideration on how the matter will proceed.

Meanwhile, a man has been arraigned before a Maralal court in Samburu County to answer charges of making a false Kenya Defence Forces document with an intent to deceive or defraud.
Appearing before Senior Principal Magistrate John Tamar, the accused, Vincent Leshan pleaded not guilty to the charges that on 18th March 2013 made a Kenyan Defense Force certificate of appointment purporting to be genuine certificate issued by Kenya Defense Forces.
He also pleaded not guilty to the offense of personating a public officer where he falsely presented himself to Baragoi police station OCS Chief Inspector Wilfred Makori on 23rd May 2021 as a person employed by KDF.
The court directed that the accused be remanded at Maralal GK prison for a period of fourteen days.
And the Marsabit County based police constable who was arrested over the brutal murder of a Matatu conductor in April this year at Stage One, in Ongata Rongai, Kajiado County has pleaded not guilty before a Machakos High Court.
Appearing before Justice George Odunga, the suspect denied charges that he and others who were not in court, arrested the deceased alongside two others only identified as Njenga and George for violating curfew orders.
The three were assaulted before being bundled into the trunk of a private car.
The victims are then reported to have been driven to Tuala bridge area where they were dumped.
