Man who defiled nine-year-old handed 20 years in jail: The Standard

A man from South West Rongo village in Migori County has been sentenced to twenty years in jail for allegedly defiling a nine-year-old girl in a sugarcane plantation.

Benard Oluoch, 36, was also found guilty of assaulting and having the carnal knowledge of the minor contrary to the law.
Rongo Resident Magistrate Raymond Langat ruled that the accused on December 8, 2019, intentionally and unlawfully defiled the minor contrary to section 8 (1) of the Sexual Offences Act.
On Thursday, the Court heard that the accused met the minor on her way home from a local market and accosted her.
The records provided in the Court as annexed affidavit showed that the accused dragged the minor to the sugarcane plantation, even threatening to strangle her if she resisted to ‘cooperate’.
In the process, Langat ruled that he caused injuries to the child.
Although he pleaded not guilty, he was found guilty of indecent act with a child contrary to section 11(1) of the Sexual Offences Act of 2006 and convicted for 20 years.
In his ruling, Langat said: ”Having carefully considered all the in record guided by the relevant principals of law, the accused is hereby sentenced to 20 years imprisonment.”
Langat delivered his judgement virtually. Normal operations at the court have partially returned after it was shut for two weeks after a staff tested positive for Covid-19.

The court became the first in Migori County to break a new ground by hearing sensitive cases virtually.
