High Court has declined to order the treatment of Moses Dola Otieno who is serving a 10-year sentence for the murder of his wife a former NTV Journalist Wambui Kabiru.

Justice Jessy Lesiit declined request by Moses Dola to be
transferred from Kenyatta National hospital to Mbagathi hospital for treatment
saying court has nothing to do with the treatment of inmates, and asked Dola to
follow the right procedure at the prison.

Through virtual link, the matter was coming up for mention
and fixing hearing dates over an appeal lodged by Moses Dola.

“There is a procedure for that (seeking medication).
The court is not the proper channel. You should involve the commissioner at the
prison,” Lesiit said.

On October 5, 2018, Dola was found guilty of manslaughter following
the death of the NTV journalist. Kabiru was found dead on May 1, 2011, in their
house in Umoja estate while Dola went into hiding. He, however, turned himself
in at Naivasha police station three days later.

In her ruling, High Court Judge Roselyn Korir who substituted
the murder charge with manslaughter, said there was no one else who could explain
exactly what happened to Kabiru on that fateful day because they (Kabiru and
Dola) were the only people in the bedroom when the incident occurred.
