Speaker of the National Assembly Justin Muturi has advised Members of County Assembly (MCAs)aspiring to seek higher electoral seats to note that their date to resign from office is February 9.
Muturi, who spoke in Nairobi, after he attended the National Executive Council briefing of the Democratic Party, in which he intends to vie for the presidency, told the party officials to ensure that aspirants who had been MCAs and now want higher electoral offices are not knocked out by a technicality.
“I am just taking the liberty to advise the Democratic Party National Executive Council that under Article 99, Clause 2, Paragraph D of the Constitution, a sitting member of the County Assembly must resign six months to the election date, which is tomorrow, February 9 for the August 9 General Election.”
Muturi noted that many MCAs wishing to vie for positions of Member of Parliament, Governor or President might miss the position of the Constitution on the requirement to resign six months before the poll date.
The Gatundu North MP Wanjiku Kibe has had a running case filed against her by her 2017 rival Kungú Waibara who wanted her term terminated by the court on the technicality of failure to resign six months before as Kiambu County MCA before she vied.
Waibara won round one and round two of the case in the High Court and in the Court of Appeal respectively, but Kibe moved to the Supreme Court where the case is awaiting final determination.
Muturi told aspirants vying through his Democratic Party to note that the party will clear only those MCAs who have already resigned within the stipulated time.
