Popular music group, Sauti Sol has irked supporters of Azimio la Umoja presidential candidate Raila Odinga after castigating their leader.
The band called out Azimio for playing one of its famous songs “Extravaganza” during the unveiling of Narc-Kenya party leader Martha Karua as Raila’s running mate.
Sauti Sol said the coalition did not have person to use the song in their meeting.
They threatened to seek legal redress.
As a result, hundreds of loyal supporters of the former Prime Minister have been trooping YouTube to unsubscribe to Sauti Sol’s channel.
Some vowed that they will never listen to the four-member group’s songs again.
However, the Kenya Copyright Board (KECOBO) supported Sauti Sol.
“The event posed the important question of whether the Collective Management Organization had authority over all sound recording exploitation. This is to clarify that the composer, publisher, and Collective Management Organization maintain independent sets of rights in a sound recording simultaneously when they are functioning. In most cases, Collective Management Organizations (CMOs) give a license allowing entities to utilize the sound recording for public performance.
“Azimio has secured a public performance license in the public domain, allowing it to play both local and international music at its rallies and events,” according to a KECOBO statement.
“In this scenario, synchronization rights are at stake, necessitating the need of a synchronization license. Only the composer and publisher can provide a synchronization license. They are in charge of negotiating and issuing synchronization licenses. The composers/performers claim that this was not done in this case.
“As a result, the complainant’s use of sound recording for synchronization without authority is infringement and consequently breaches Kenya copyright law,” the statement continued.
Raila Odinga’s party, the Orange Democratic Movement (ODM), had previously stated that playing the song was a demonstration of love for the band.
“We’d like to reassure our celebrated musical team @sautisol that we adore and respect their work.” Every Kenyan thanks the group for flying our country’s flag so high in foreign circles. The ODM Party’s statement adds, “Playing their song yesterday was a gesture of love for their work.”
