Senator Cherargei Forced to Write Apology Letter to Judge

Nandi Senator, Samson Cherargei, was forced to write an apology letter to a judge in a bid to get a warrant of arrest issued against him withdrawn.

The Senator was forced to apologise to Chief Magistrate Wendy Kagendo for skipping the trial of a hate speech case with no explanation.

Cherargei and his lawyer, Duncan O’Kubasu, apologised to the Magistrate for skipping a hearing that was slated for April 19.

The duo promised to observe the rules and respect the court in their letters to Justice Kagendo. 

Senator Cherargei and O’Kubasu also apologised to the deputy director of public prosecutions, Alexander Muteti, over their misbehaviour and utterances that demeaned prosecutors. 

Muteti absolved O’Kubasu of blame but asked the court to direct him to follow the law as he embarks on his duties within the corridors of justice.

“I also urge this court to direct O’Kubasu to notify us when he is proceeding before Justice Grace Nzioka so that we can also be present,” Muteti prayed.

Justice Kagendo pardoned the two and cancelled a warrant of arrest that had been issued against the Senator.

The Senator has been on the spot in the recent past over allegations of making remarks bordering hate speech. This has seen him appear before the court after the Director of Public Prosecutions (DPP) ordered his prosecution.

Cherargei engaged in a heated exchange with a Magistrate over what he claimed was unfairness in the court system. 

He accused the Magistrate of being biased against him in the case, which led to an altercation that lasted for over an hour.

Efforts by the Magistrate to urge the Senator to stand down bore no fruits as Cherargei alleged that Magistrate had a vendetta against him. 

“Why am I being intimidated? I thought courts are safe? They are even calling a police inspector! These are hostilities!” he lamented.
