A protracted dispute over a prime property pitting two brothers in Parklands, Nairobi has taken a new twist after a key prosecution witness disappeared in unclear circumstances.
Mr Raji Singh Gill, who has sued his brother, Jasbir Singh Gill and his son Alvider, for malicious damage to the property now claims that the witness, Kennedy Odari, a security guard, was intimidated.
The two are embroiled in a legal tussle over a multi-million shillings property they inherited from their father.
“I have reason to believe that my witness was threatened or compromised in a bid to defeat justice. He could not appear in court to testify and as a result, the case could not proceed,” Mr Raji said.
NOT BONDED TO TESTIFY
Mr Raji, 66, says he was not bonded to testify in the case yet he is the complainant.
The two brothers are embroiled in a number of criminal cases against each other.
Interestingly, the missing guard is a witness in two other cases involving the two brothers.
The case which was before Kibera Chief Magistrate Joyce Gandani was withdrawn after witnesses failed to appear in court.
Mr Raji said the withdrawal of the case embolden the accused who has continued to threaten his family.
LIVING IN FEAR
“My family is living in fear. The accused, who is my kin has continued to threaten me with dire consequences from the time the case was terminated prematurely,” he said.
He has reported the threats to the police.
In the terminated case, Mr Raji is accusing Mr Jasbir of damaging his door and flower vases valued at Sh19,000. His son Alvider is also charged with creating disturbance by hurling unprintable abuses at Mr Raji.
Mr Jasbir and Mr Alvinder denied the charges.
