A man, Michael Mutembei, has filed a petition seeking a thorough appraisal and subsequent removal from the office of Justice Anthony Mrima, who had issued an arrest and detention order to the Directorate of Criminal Investigations (DCI) boss, George Kinoti, for alleged contempt of court case.
Kinoti was to serve a four-month jail term at Kamiti Maximum Prison, according to the court order given by the High Court judge.
In the petition through lawyer Dunstan Omari, Mutembei accused the judge of gross misconduct and favoritism in the ruling he made with questions on why he decided to land his axe on Kinoti leaving out the other three respondents listed in the case.
“This inevitably demonstrates that the accused judge was acting discriminately and out of vengeance and ill will,”
“The Judicial Service Commission be pleased to order the immediate suspension of the Honorable justice Anthony Mrima for his open show of bias, incompetence, corruption, misbehavior, and misconduct in the exercise of his judicial functions in Petition no.520 of 2017 between Jimi Wanjigi and another versus Inspector General of Police and 3 others,” reads an excerpt of the court documents.
He further asked JSC to determine whether the verdict was influenced by billionaire Jimmy Wanjigi, who is the complainant in the firearms case, as the adjudication by Mrima raises suspicion as it is against the Sentencing Policy Guidelines that all courts are bound to follow.
Mutembei went ahead and praised Kinoti as a man who is dedicated to his work and a patriot who, not for once, has risked his life in service.
“That it is appalling and a clear abuse of the judicial discretion to have witnessed the accused judge run over the Director of Criminal Investigations and to have convicted him to jail for fours months without any other option for the decision of the court… trivializes the role Mr. Kinoti has played to bring security and tranquility within the Country.”
