Supreme Court BBI Judgment: Njoki Ndungu Becomes 1st Judge to Defend Uhuru

In her judgment, Justice Njoki Ndungu took a different path from his colleagues who had delivered their verdicts earlier on the Building Bridges Initiative (BBI).

These are the takeaways from Njoki’s judgment:

1. President Uhuru Kenyatta justified to initiate constitutional reforms through the popular drive. He is a Kenyan and was elected by Kenyans.

2. The electoral commission had necessary quorum when it verified the BBI signatures.

3. The multiple question referendum issue premature.

4. Second schedule of BBI that proposed creation of additional 70 new constituencies unconstitutional.

5. There was thorough public participation in the BBI process.

6. The President is immune to civil proceedings while still at the helm.

7. The Basic structure not applicable because there are no eternal sections in the constitution.

Of the judges who have made their arguments, only Njoki appeared to Defend President Kenyatta so far.
