CAS Beatrice Elachi to Be Surcharged for Abuse of Office – Kenyan Business Feed

Chief Administrative Secretary (CAS) for Public Service and Gender Beatrice Elachi is in trouble after MCA’s called for her to be investigated and surcharged.

The former Nairobi County Assembly speaker is facing charges of abuse of office over malpractices that took place when she was in charge at City Hall.

According to the report tabled by the Justice and Legal Affairs Committee, the Service Board flouted the promotion and recruitment laws in the 2020 Promotions.

It cited ethnicity and lack of experience among the staff promoted and lack of budgetary allocation for the same.

“The creation of offices review of organization structure , promotion of staff and recruitment undertaken do not confine with the law specifically the provision section 37 of the public service commission Act 2017… Organisation Review exercise conducted outside the establishment framework under section 24 (4) of the Assembly Service Act 2017, regulation, guidelines and policies …the organisation review are hereby declared, null and void and promotions be revoked or quashed as such in totality.” read the report.

The Ethics and Anti- Corruption Commission put the CAS and the Nairobi County Service Board at the centre of the Investigations after the promotion were pronounced to have been in total disregard of the law.

In his support for the investigations, Majority Leader Abdi Guyo said it’s shocking how the former board did things without consideration of the law.

According to Guyo, the advertisement was supposed to run for 21 days and not two days as the Board did, accusing the board for coming up with a non-existing structure.

“The report is shocking and it shows how the former board did things without following the law …when someone advertises for two day yet law says at least 21 days …the former board came with non-existing structures. It’s Very clear that there was no budgetary allocation ..this is criminal ,null and void. Everything here was sole decision of chair not board She abused her powers when in office.” Said the Majority leader Abdi Guyo.

An attempt by nominated MCA Mary Ariviza to bar the house from discussing the report because the Matter is in court didn’t succeed as the Speaker ruled that standing order 94 of the assembly did not bar them from conducting their business.

The Legal Affairs Committee chair promised that they would give a report after 14 days on the implementation progress.

Panic has now engulfed the 28 employees with some threatening to go to court should they be demonstrated as the report recommended.
