Court awards MP Mohammed Ali Ksh 1m over defamation story – KBC

A Court in Nairobi has awarded Nyali MP Mohammed Ali Ksh 1m as defamation costs for a story published by a local daily.

The Court further directed the Newspaper to cater for the cost of the suit and interest at Court rates from the date it was filled until payment in full.

Ali moved to Court after the Newspaper published a story claiming the MP had fired 3 constituency employees after being caught up in a CDF bursary scam.

In his submissions, Ali said the story was malicious saying he hadn’t been arrested nor summouned by any investigative agency including the EACC over the issue.

He further told the Court that he is not a signatory of the CDF account adding that no one from the Newspaper called him for any clarification.

In her ruling, Milimani Magistrate S.G Gitonga said, “Owing to the fact that the plaintiff was afforded a right of reply and a clarification was also published to make clarifications and directly apologize to him, I award the plaintiff a sum of Ksh 1m as general damages for the tort of defamations.”
