Court bars man from accessing WOW beverages director’s Ksh.250M Karen land

High court has issued a temporary order stopping Eric Agolla Lugalia from entering and encroaching or interfering with a parcel of land situated in Karen –Bogani Road.

Further the court has directed that officer in charge of Karen Police station ensure maintenance of law and order in the said land valued at Ksh.250 million belonging to businessman Stuart Gerald Cullinan Herd, one of the WOW beverages directors.

According to documents seen by Citizen Digital, it is alleged that on May 20 this year, one Eric Agolla Lugallia was seen at the property, which he claimed to have been given by late President Daniel Moi but after interrogation he fled.

Mr. Herd says he was informed by his security that a stranger wanted to access his plot and after police were alerted they found Agolla at the property.

“They took photos of him, his car and his ID that he produced when police demanded to see it,” reads the documents.

In the court documents the petitioner (Agolla) says the alleged raid and arrests in his property was trespass, illegal, unlawful and abuse of legal process.

He says that as a result of the trespass he has suffered inconvenience and unjustified harassment by the National Police Service following Eric’s allegations that he owns the property.

“That although I am still in physical and actual possession of the property. I am apprehensive based on the above past incidence that the defendants by himself ow with armed gangs will yet again unless restrained by the court invade,” reads court documents.
