Day Uhuru Vouched For BBI Win at Court of Appeal: ‘Itapita Msijali’

President Uhuru Kenyatta’s hopes that the Building Bridges Initiative (BBI) would be redeemed by the Court of Appeal dulled yesterday after seven judges stopped him and ODM leader Raila from making broad constitutional changes.

Just the High Court, the Appellate Court declared that the Head of state acted unconstitutionally by initiating the Constitutional (Amendment) Bill, 2020, popularly referred to as BBI.

Justices Daniel Musinga, Patrick Kiage, Hannah Okwengu, Gatembu Kairu, Fatuma Sichale, Roselyn Nambuye, and Francis Tuiyott did not only dismiss the whole thing but also hard on the President.

They said the avenue to change the law through the popular initiative is an exclusive reserve for the common man, but not for someone who has been enjoying trappings of power for the last nine years.

“The days of an unaccountable President are long gone,” Justice Kiage said.

In May this year shortly after the appeal had been lodged at the Court of Appeal, the Head of State was assertive that the BBI team would carry the day.

Speaking at a gathering in Siaya when he launched and commissioned projects in the Nyanza region, the President pegged his hope on Siaya Senator James Orengo to win the petition.

“With lawyers like Orengo on board, you can be sure we will win. Don’t worry because I’m we will get BBI back on track,” he said.

Legacy 

Not once or twice President Kenyatta has declared that BBI is his legacy project.

Top politicians seeking his endorsement in next year’s presidential election had actively leveraged on the BBI to attract the attention of the Head of State.

The Court of Appeal’s verdict complicated the succession arithmetic further, as the proposal to fatten the Executive would have made it easier for the President to broker a deal between ODM leader Raila Odinga and co-principals of the One Kenya Alliance.
