Embakasi East lawmaker Babu Owino has been acquitted in the attempted murder case against Felix Orinda AKA DJ Evolve.
This ruling which was given on December 14, 2021, by Magistrate Bernard Ochoi, comes after the Orinda family allowed an out-of-court settlement with Owino, therefore withdrawing the case.
However, the ruling did not mean that Owino will be set free wholly as he will still answer to the charges of misbehavior with a firearm while in public.
Magistrate Ochoi had ordered both parties to submit proper documents that reflect details of their conciliation ahead of the ruling to pull out the case. This is after the prosecution insisted on further investigations on why DJ Evolve had resorted to taking back the case and perceived Owino’s influence.
Ochoi pointed out that their application did not meet the threshold but maintained open avenues for further engagement in July before the official request to throw out the case in October 2020.
DJ Evolve noted that the settlement of the case was reached to haste the reconciliation as he is focusing on getting better.
The court said that it was not notified whether Owino compensated DJ Evolve.
DJ Evolve was admitted to Nairobi Hospital in critical condition on January 17, 2021, following a dramatic shooting in the neck at Nairobi’s B-Club.
The duo is said to be in a disagreement about the size of their “guns” before Owino reached into his pockets to remove Steyr M9-A1, a real gun.
“Babu went into his pocket, pulled out a gun, and swiftly shot at him twice,” a reveler claimed.
