A driver in Embu has had his driving license revoked, and was banned from obtaining one for a period of 15 years after he was convicted of causing death
Maurice Nyaga Ndwiga 46, will also serve three years in jail on account of speeding and driving carelessly, causing the death of Benard Lutere Njiru, a pedestrian along Embu-Kibugu-Road.
He was found guilty of the offence that he perpetrated on the evening of September 11, 2020.
While passing the sentence, Senior Resident Magistrate, Tonny Kwambai, noted he gave a lenient sentence of three years because Nyaga was a first-time offender.
In the sentence, Kwambai also cancelled Nyaga’s driving license and declared him disqualified from obtaining another driving license for a period of 15 years.
“In addition, and pursuant to Section 76 (1) (a) of the Traffic Act part VIII, I cancel his driving license and declare him disqualified from obtaining another license for a period of 15 years,” said Kwambai.
According to the charge sheet Nyaga, on September 11 2020, around 7.00 P.M a long Embu-Kibugu-Road, was speeding and driving recklessly thus putting the lives of pedestrians at risk.
He hit the deceased as he was crossing the road to head to his home which is at Kibugu.
