Havi Suffers a Major Blow After Court Defends LSK CEO Mercy Wambua’s Ouster

Law Society of Kenya (LSK) President Nelson Havi has suffered a major blow after the High Court in Nairobi dismissed the ouster of LSK Chief Executive Officer (CEO) Mercy Wambua which took place in June 2021.

Wambua was forced out of office for a compulsory leave by LSK members who convened a Special General Meeting (SGM) where 118 members supported her ouster and resorted to voting for a new CEO after 45 days.

Defending her ouster, Wambua moved to court to counter the move by the LSK council. Luckily, Justice Antony Mrima threw out the resolution of the SGM on grounds that it was not legally convened, and thus, Wambua remains legally in office.

The Court further ordered LSK to organize a meeting within 21 days after the ruling to discuss issues affecting it and chart a way of solving the problems which have hindered its operations.

Havi and Wambua have been at loggerheads and this had led to the rise of splinter groups at LSK, with radicals being on Havi’s side and conservatives on Wambua’s side.

In July 2021, Wambua headed to the Directorate of Criminal Investigation (DCI) headquarters with claims that Havi had assaulted her after she availed herself at a meeting organized by LSK officials. She said that Havi had bruised her right arm and finger during the scuffle.

“We are here at DCI headquarters with my client who is finalizing her statement with the detectives,” Steve Ogola, Wambua’s lawyer had said.

On his part, Havi reiterated by stating that Wambua had stormed the meeting uninvited, and he requested her to leave, but the request fell on deaf ears. Furthermore, he accused Wambua of squandering millions of the Society’s money.

“Mercy Wambua is shielding her principals, two immediate former Presidents of LSK from liability for plunder of hundreds of millions,” he stated.
