High Court Upholds Ex-Nairobi Governor Mike Sonko’s Impeachment – LitKenya

The High Court has endorsed the impeachment of Mike Sonko as Governor by the Nairobi County Assembly and the Senate.

The ruling was delivered on Thursday, 24th June, by a three-judge bench of Justices Wilfrida Okwany, Said Chitembwe, and Weldon Korir.

Sonko had gone to the court seeking to overturn his impeachment, which he claimed was unconstitutional.

“We do not see any external hand in the impeachment of Sonko…We do not find any merit that his impeachment was engineered. We come to the conclusion that the impeachment of Sonko was constitutional…,” the judges said.

The court also upheld the nomination and appointment of Anne Kananu as Nairobi Deputy Governor.

This was a big blow to Sonko, who had earlier objected to Kananu’s appointment, claiming that he had withdrawn her nomination in a letter dated 7th December 2020.

“The court finds that the nomination, vetting, approval and swearing-in of Anne Kananu as the Deputy Governor was constitutional and lawful. All petitions challenging her ascendancy are without merit and are hereby dismissed.”

Kananu, who assumed office in January, as the Deputy Governor after being vetted by the MCAs, will not be officially sworn in as Nairobi’s third Governor yet, pending Sonko’s appeal against today’s High Court ruling.

Sonko was ejected from office in December 2020 over claims of abuse of office, gross violation of the law, committing a crime under the national and international laws, and lacking the capability to run the county.
