Machakos Governor Mutua Suspends County’s Attorney Over Gross Misconduct

Machakos County Governor Alfred Mutua has suspended County’s Attorney James Musango Kathili over alleged violation of the constitution, gross misconduct and dereliction of duty.

In a statement issued on Monday, 29th November the county boss said that the suspension was aimed at paving way for Kithili’s procedural removal and forestalling the prospect of interference with proceedings against the Attorney.

“In order to pave way for a fair removal process and minimize the possibility of interference with proceedings, I have with immediate effect suspended Hon. James Musango Kathili from office as County Attorney of the County Government of Machakos,” read part of the statement.

“This has been necessitated by a serious violation of the Constitution and other laws, gross misconduct, incompetence, dereliction of duties as well as unprofessional and unethical conduct on his part.”

Mutua said he would be forwarding the reason for his decision to the County Assembly to ratify Kathili’s removal.

“In accordance with Section 13 of the office of the County Attorney Act 2020. I will be transmitting the specific reasons for this decision to the County Assembly for approval to enable removal from office.”

Kithili who has not responded to the raft of allegations against him by his boss was sworn in as the county’s first attorney general on 30th November, 2020.
