Speaker Lusaka declares Isaac Mwaura’s seat vacant – KBC

Senate Speaker Kenneth Lusaka has on Tuesday declared the seat held by nominated Senator Isaac Mwaura vacant after the Jubilee Party expelled him.

This comes after the Political Parties Disputes Tribunal upheld the decision of the Jubilee Party to expel the nominated senator on grounds of indiscipline.

The tribunal found that the party had followed due process in expelling the Senator and also noted that there was compliance with laws regarding disciplinary proceedings.

“It is notified for the information of the general public that pursuant to Article 103 (1) (e) (i) of the Constitution and section 37 of the Elections Act, the seat of the Member of the Senate elected under Article 98 (1) (d) of the Constitution and held by Hon. Isaac Mwaura Maigua became vacant, with effect from the 7th May, 2021,” said Speaker Lusaka in a gazette notice.

Mwaura was among six Senators who were expelled by the ruling party in February for alleged gross misconduct.

The other Senators include; Seneta Mary Yiane, Wago Naomi Jilo, Millicent Omanga, Prengei Victor and lman Falhada Dekow were also kicked out for breaching the party’s constitution.

The Jubilee Party had vowed to take disciplinary actions against legislators who refuse to toe the line.

Last month, the High Court had temporarily suspended the decision by the ruling party to expel Mwaura pending hearing of his case.
