Chief Justice Martha Koome and six other judges of the Supreme Court are this afternoon delivering the final judgment regarding the Building Bridges Initiative (BBI).
Koome has made her submissions and the following points are a summary of her arguments.
1. President Uhuru Kenyatta cannot initiate constitutional changes through the popular drive.
2. The President cannot be sued while still in office as the High Court and Court of Appeal had declared.
3. Proposals in the Building Bridges Initiative (BBI) will not interfere with basic structure of the constitution. The doctrine not applicable in Kenya.
4. The BBI was subjected to adequate public participation. A majority of the county assemblies approved the referendum Bill.
5. The electoral commission was properly constituted when it vetted BBI signatures.
6. Creation of the 70 new constituencies in BBI Bill unconstitutional.
7. Each of the parties in the BBC case to bear own cost.
