TSC Announces Changes in Maternity, Paternity Leave Days

Teachers Service Commission (TSC) boss Nancy Macharia has announced an alteration of paternity and maternity leave days for educators in the country.

Macharia said that female tutors will now get four months of maternity leave while male tutors will be granted three weeks. Also, those who will go for a pre-adoptive leave have been given 45 days from the date of adoption.

All these changes conform with the 2021-2025 Collective Bargaining Agreement (CBA), which also states that teachers will be paid full salary when they take leave.

“The Code of Regulation for teachers (2015), read together with the CBA (2021-2025), have specific provisions for maternity, paternity, and pre-adoptive leave. In line with the said provisions, all teachers are eligible for only one leave at a time,” she stated.

Previously, female teachers would go for three months of maternity leave while male tutors were given only ten days off.

Macharia noted that maternity, paternity, or pre-adoptive leave does not affect annual leave, and teachers, who will go for any of the leave, shall also be legible to go for their annual leave in the same year.

“This leave is exclusive of annual leave. The application for leave should be submitted to the DEO/MEO/DCE through the head of the institution at least one month before the leave is due and must have supporting medical documents,” read an excerpt from the TSC site.

Macharia added that the process of applying for leave is currently available on the TSC website.

This new regulation points out that polygamous teachers will only be allowed to go on leave when the wife, whose name appears on National Hospital Insurance Fund (NHIF) card, is on maternity leave.
