Teachers Service Commission (TSC) CEO Nancy Macharia has been criticized by the Commission on Administrative Justice (CAJ) after allegations that the appointment of senior managers was marred with irregularities.

CAJ, through Ombudsman Florence Kajuju pointed out that TSC breached the National Cohesion and Integration Act of 2008 and the Constitution.

Kajuju told off TSC for appointing persons from one particular region. Reports indicate that the majority of the appointees are drawn from the Mount Kenya region who have taken 11 slots and the rest shared amongst other regions.

“Whereas the commissioners and senior managers are supposed to reflect the face of Kenya, the current composition at TSC gives a different picture.”

“Our complaints’ office will write to the TSC, which is the institution complained against, for a response on the issues highlighted in the petition. The management of TSC will then be summoned to appear before CAJ to state its case,” read part of the petition.

Kajuju further explained that according to the law, a government entity is barred from having more than two-thirds of its staff from the same ethnic community.

“When you take a close look at the composition of senior managers and commissioners at the TSC, it is evident that Mount Kenya region is favored as it has the lion’s share,” the petition stated.

The claimant decided to seek a legal remedy with claims that the commission hired top officials as a move to protect the interests of its CEO, Nancy Macharia.
